Terms of Service
These Terms of Service (the "Terms") are a legal agreement between you and Mission Control Kids LLC ("Mission Control Kids," "we," "us," or "our") governing your use of missioncontrolkids.com and any related applications or services (collectively, the "Service"). By creating an account, by checking the "I agree to the Terms of Service" box at signup, or by using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.
These Terms include an arbitration clause and a class-action waiver in Section 14. Please read those carefully.
1. Who Can Use the Service
You may register a household account only if all of the following are true:
- You are at least 18 years old.
- You are the parent or legal guardian of any child whose sub-account you create.
- You have the legal authority to enter into a binding contract.
- You are not barred from using the Service under the laws of the United States or your state of residence.
Children under 18 may not register a household account. Children under 13 may use the Service only through a sub-account that has been created and is supervised by their parent or legal guardian, under our COPPA-compliant verifiable parental consent process (see our Privacy Policy).
2. Your Account
You are responsible for everything that happens under your household account, including all activity in any child sub-account you create. Keep your password confidential. If you suspect any unauthorized use of your account, notify us promptly at coppa@missioncontrolkids.com.
You agree that the information you provide at signup and during your use of the Service is accurate, current, and complete, and that you will keep it updated.
3. The Service
The Service is a household management tool that helps you track and manage your children's chores, nutrition, exercise, and allowance. We may add, change, remove, or temporarily suspend features at any time. We will give reasonable notice of material changes that affect a paid subscription.
The Service is not a medical, nutritional, fitness, or financial advisory service. The nutrition, exercise, and allowance features are organizational tools. You are responsible for any health, dietary, or financial decisions you make for your child.
4. Subscription, Billing, and Cancellation
The Service is offered on a paid subscription basis. By providing a payment method and starting a subscription, you authorize us and our payment processor, Stripe, to charge the listed subscription fee to your payment method on a recurring basis (monthly or annual, as you select) until you cancel.
- Renewal. Your subscription renews automatically at the end of each billing period at the then-current rate unless you cancel before the renewal date.
- Cancellation. You can cancel at any time from inside your account. Cancellation takes effect at the end of the current billing period. You retain access until then.
- Refunds. Subscription fees are non-refundable except where required by law. If you believe a charge was made in error, contact us at coppa@missioncontrolkids.com within thirty days and we will review in good faith.
- Price changes. We may change the subscription price. We will notify you by email at least thirty days before a price change takes effect. If you do not agree to the new price, you may cancel before it takes effect.
- Taxes. Listed prices do not include any applicable taxes. You are responsible for any sales, use, or value-added taxes that apply.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Use the Service to harass, threaten, or harm any person, including any child
- Attempt to access another household's account or any non-public area of the Service
- Probe, scan, or test the vulnerability of the Service, or breach any security or authentication measure
- Interfere with or disrupt the Service, the servers, or the networks connected to the Service
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except where this restriction is prohibited by applicable law
- Use any automated means (bots, scrapers, crawlers) to access the Service without our prior written permission
- Misrepresent your identity or your relationship to a child whose sub-account you create
- Use the Service to collect or harvest any personal information about other users
- Resell, sublicense, or commercially exploit the Service or any portion of it
We may suspend or terminate your access to the Service at any time, with or without notice, for any violation of these Terms or for any conduct that we believe in good faith is harmful to other users, to us, or to any third party.
6. Content and Information You Provide
You retain ownership of any household configuration, chore lists, notes, or other information you submit to the Service. You grant Mission Control Kids a worldwide, non-exclusive, royalty-free license to host, store, process, and display that information solely as necessary to operate and improve the Service for you.
You are responsible for ensuring you have the right to submit any information you put into the Service, and that doing so does not violate any third party's rights or any law.
7. Privacy
Our handling of personal information (including children's information) is described in our Privacy Policy. By using the Service, you agree to the practices described there. The Privacy Policy is the controlling document for any conflict between these Terms and the Privacy Policy on questions of how we handle personal information.
8. Intellectual Property
The Service, including its software, design, branding, text, graphics, and other content (other than information you submit), is owned by Mission Control Kids or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial household management. We reserve all rights not expressly granted.
"Mission Control Kids" and the Mission Control Kids logo are trademarks of Mission Control Kids LLC. You may not use them without our prior written permission.
9. Third-Party Services
The Service relies on third-party providers for hosting, payment processing, and SMS delivery. Your use of those features is also subject to the relevant third party's terms (Vercel, Stripe, Twilio). We are not responsible for the acts or omissions of any third-party provider, except where we have direct contractual responsibility under a data processing agreement.
10. Disclaimers
The Service is provided "as is" and "as available," without any warranty of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim all warranties, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any information stored on the Service will be accurate, complete, or available at any particular time.
The Service is not a substitute for professional medical, nutritional, fitness, financial, parenting, or legal advice.
11. Limitation of Liability
To the maximum extent permitted by law, in no event will Mission Control Kids LLC, its officers, directors, employees, contractors, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including damages for loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service, whether based on contract, tort, statute, or any other legal theory, and whether or not Mission Control Kids has been advised of the possibility of those damages.
In any event, the total liability of Mission Control Kids to you for all claims arising out of or in connection with the Service or these Terms will not exceed the greater of (a) the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim, or (b) one hundred US dollars.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the extent permitted by law.
12. Indemnification
You agree to defend, indemnify, and hold harmless Mission Control Kids LLC and its officers, directors, employees, and agents from and against any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or any right of any third party, or (d) any information you submit to the Service.
13. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. On termination, your right to use the Service ends, and we may delete your account and any associated information in accordance with our Privacy Policy. Sections that by their nature should survive termination (including Sections 6, 7, 8, 10, 11, 12, 14, and 15) will survive.
14. Disputes and Arbitration
Please read this section carefully. It affects how disputes between you and Mission Control Kids are resolved.
14.1 Informal resolution first
If you have a dispute with us, you agree to first contact us at coppa@missioncontrolkids.com and to try in good faith to resolve the dispute informally for at least sixty days before starting any formal proceeding.
14.2 Binding arbitration
If the dispute is not resolved within sixty days, then except for the claims listed in Section 14.4, you and Mission Control Kids agree to resolve any dispute arising out of or related to the Service or these Terms by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration will be conducted by a single arbitrator. The seat of arbitration is Collin County, Texas. The arbitrator may award any relief that a court could award.
14.3 Class action waiver
You and Mission Control Kids agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
14.4 Carve-outs
This Section 14 does not require arbitration of (a) small claims court actions if the claim qualifies, (b) claims for injunctive or equitable relief to stop unauthorized use of or access to the Service, or (c) any claim that cannot be arbitrated under applicable law.
14.5 Opt-out
You may opt out of this arbitration agreement by emailing coppa@missioncontrolkids.com within thirty days of first accepting these Terms, with "Arbitration Opt-Out" in the subject line and your name and the email address on your account in the body. Opting out does not affect any other part of these Terms.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. For any claim that is not subject to arbitration under Section 14, you and Mission Control Kids agree to submit to the exclusive jurisdiction of the state and federal courts located in Collin County, Texas.
16. Changes to These Terms
We may change these Terms from time to time. If we make a material change, we will notify you by email and post the updated Terms on the Service at least thirty days before the change takes effect. Your continued use of the Service after the effective date of the change is your acceptance of the updated Terms. If you do not agree, you may cancel your account before the change takes effect.
17. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Mission Control Kids about the Service, and they supersede any prior agreements on that subject.
- Severability. If any part of these Terms is found to be unenforceable, the rest will remain in effect.
- No waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, or by operation of law.
- No agency. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Mission Control Kids.
- Notices. We may give you notice by email to the address on your account or by posting on the Service.
18. SMS Program Terms
If you provide your mobile number to Mission Control Kids and affirmatively opt in to our SMS messaging program, the following terms apply, in addition to and not in place of the rest of these Terms and the related disclosures in our Privacy Policy, Section 4. A plain-language summary of this program, including a live preview of the in-app opt-in form, is available at missioncontrolkids.com/sms-terms.
18.1 Program description
The Mission Control Kids SMS program sends two kinds of messages to enrolled parents: (a) Service notifications related to the parent's household account (for example, that a child completed a chore, or account or billing notices), and (b) the optional "daily mission tips" welcome series, an educational series of up to 14 messages on running a household with kids.
18.2 How to opt in
You opt in to the welcome series by checking the unchecked SMS-consent box on the phone-verification step of the signup wizard at missioncontrolkids.com/verify-phone. Consent is not a condition of purchase or of using the Service. You may use the Service without opting in. You may opt out at any time by replying STOP to any message, as described in Section 18.6.
18.3 Message frequency
The welcome series consists of up to 14 messages, one per day for up to 14 consecutive days, sent at 7am in your local timezone, after which the series ends permanently. Service notifications are sent on an as-needed basis and frequency varies based on your household's activity.
18.4 Carriers and message rates
The Mission Control Kids SMS program is available on all major US carriers. Carriers are not liable for delayed or undelivered messages. Message and data rates may apply, depending on your mobile plan. You are responsible for any charges your wireless carrier imposes for sending or receiving SMS messages.
18.5 Eligible numbers
You may only enroll a mobile number that you own or are otherwise authorized to use. By enrolling, you represent that you are the subscriber or authorized user of the number.
18.6 Opt-out (STOP)
You may opt out of all Mission Control Kids SMS messages at any time by replying with any of the following keywords to any message we have sent: STOP, STOPALL, OPTOUT, CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE. After opting out, you will receive a single confirmation message and no further messages from the SMS program. To resubscribe, reply START, or re-opt in via the signup wizard.
18.7 Help (HELP)
You may request program contact info at any time by replying HELP or INFO to any message we have sent. We will respond with program contact information and opt-out instructions. For additional support, email help@missioncontrolkids.com.
18.8 Changes to the program
We may modify or discontinue the SMS program at any time, with or without notice. If we make material changes that affect enrolled recipients, we will notify enrolled recipients by SMS or email before the change takes effect.
